B. Automatically Collected Usage and Device Information

Like most websites, our Site uses various technologies to automatically collect information about visitors. Those technologies include:

  • Cookies. Cookies are small text files that a website transfers to a visitor’s device for recordkeeping purposes. We use cookies to personalize visitors’ experiences, provide content we believe may be of interest, track visitor trends and patterns, engage in marketing and advertising, and otherwise analyze our Site traffic. To manage your cookie preferences, please review the settings available in your browser or device.
  • Log Files and Device Identifiers. We use log files to track actions occurring on the Site and collect data about visitors, including IP address, browser type, internet service provider, referring/exit pages, date/time stamps, and device identifiers.
  • Web Beacons and Other Technologies. Our Site may use other tracking tools, including web beacons (also known as clear gifs, pixel tags, and single-pixel gifs), which are small electronic images embedded in content and email messages that are not ordinarily visible to users. Web beacons allow us to track pages and content accessed by users and to monitor email readership.
  • Analytics. Our Site may use third-party analytics tools such as Google Analytics to understand how the Site is used. If you wish to opt out of Google Analytics, you can use Google’s opt-out browser add-on.
  • Behavioral Tracking. We may use behavioral tracking to improve your user experience and deliver relevant advertisements. This includes tracking patterns across our Site and affiliated channels to personalize content and marketing.

The information collected through these technologies may be combined with personal information or aggregated with other information about Site visits. We may share information about your use of our Site with our advertising and analytics partners, who may combine it with other information you previously provided to them.

C. Information from Social Media

If you interact with us on any social media platform:

  • Depending on your social media privacy settings, the personal information you submit on the platform may be read, collected, or used by us as described in this Policy.
  • Where we respond to any interaction with you on social media, your account name or handle may be viewable by members or users of our social media accounts.

Social media platforms operate independently from Right Away Construction, and we are not responsible for the personal information you choose to submit or link on any social media platform. We may use publicly available social media data or tools to improve our marketing efforts, personalize interactions, and enhance your experience. Please review the privacy policies and settings of any social media platform with which you interact.

D. Information from Other Sources

We may obtain both personal and non-personal information about you from our affiliated businesses, contractors, suppliers, and other third parties, and add it to information we have already collected. This may include combining your data with publicly available information, such as property data, to enhance our service offerings or tailor our marketing efforts. If you provide us personal information about others, or if others give us your information, we will only use that information for the specific reason for which it was provided to us.

Data Retention – We retain personal information only for as long as necessary to fulfill the purposes described in this Policy — including providing the services you have requested, maintaining accurate business and financial records, and resolving disputes — unless a longer retention period is required or permitted by law, contract, or other legitimate legal or business purposes.

How We Use Personal Information

  • We (or service providers acting on our behalf) may use the personal information identified above for the following purposes:

  • Negotiating, entering into, and managing our business relationship with you or your company, including generating estimates or quotes, scheduling appointments and project work, providing our services, and processing payments.

  • Registering you for an account so that you may pay bills online and otherwise engage with our services via the Site.

  • Providing and optimizing your experience on our Site and presenting our content in the most effective manner.

  • Communicating with you and responding to your inquiries regarding our services, our agreements with you or your company, project updates, and other issues, including by email, phone, and text (SMS) message.

  • Sending you promotional or informational communications and materials, tracking your marketing preferences, and for our internal marketing purposes.

  • Managing customer service issues.

  • Developing, updating, and improving our services, customer service, and customer experience, and improving our knowledge and insights regarding customers.

  • Preventing and detecting fraud, financial crime, hacking activities, security breaches, and other unlawful activities in connection with the Site or our services.

  • Enforcing our agreements with customers, complying with our legal or regulatory obligations, and defending or advancing legal claims.

  • Notifying you about changes to our Site, services, or material changes to this Policy.

  • Providing you with surveys or otherwise soliciting feedback from you.

Text Messaging (SMS/MMS) Privacy

If you provide us with your mobile telephone number and opt in to our text messaging program, you consent to receive text (SMS/MMS) messages from Right Away Construction. These may include transactional and service messages (such as appointment and estimate reminders, project and service updates, scheduling confirmations, account notifications, and responses to your inquiries) and, where you have opted in, marketing and promotional messages.

Your consent to receive text messages is not a condition of purchasing any goods or services. Message frequency varies. Message and data rates may apply. You can opt out of receiving text messages at any time by replying STOP to any message or by contacting us using the information at the end of this Policy. For help, reply HELP or contact us at info@RightAwayCo.com or 612-255-9605 or 612-414-5885.

No sharing of mobile opt-in data for marketing. We do not sell, rent, or share your mobile telephone number, SMS opt-in information, or text-messaging consent with any third parties or affiliates for their own marketing or promotional purposes. We may share your mobile information only with service providers (such as our text-messaging platform and carriers) strictly as needed to deliver the messaging services you have requested. Additional terms governing our text messaging program are set out in our Terms and Conditions.

Our Marketing and Communications

We may send you direct marketing communications, appointment reminders, or service updates from time to time, including news, updates, offers, and other promotions relating to our services. We may contact you by email, telephone call, or text (SMS) message, consistent with your communication preferences and applicable law.

You may opt out of receiving marketing communications at any time by clicking the “unsubscribe” link in an email, by replying STOP to a marketing text message, or by contacting us directly. Please note that even if you opt out of marketing communications, we may still send you non-promotional, transactional, or service-related messages, such as those about an active project, estimate, or account.

We do not sell or share your personal data with unaffiliated third parties for their own direct marketing purposes.

Advertising and Your Choices

We want to serve you advertising that is relevant and useful to you, so we may use personal information you have provided, or information collected through cookies and similar technologies, to personalize ads and improve your experience with us on our Site and on other sites. The ads you see may be based on previously collected data, such as prior searches, activity, visits to sites or apps, or demographic information. The information we share with our advertising partners to deliver personalized ads is shared securely, is often hashed or de-identified, and may not be used by those partners for any other purpose. We do not sell your data to third parties.

For more information about ad personalization and to opt out of interest-based advertising by participating third parties, you may visit the Network Advertising Initiative at https://optout.networkadvertising.org and the Digital Advertising Alliance at https://optout.aboutads.info. For mobile apps, you may use the DAA’s AppChoices tool at https://youradchoices.com/appchoices. Opting out through these programs applies only to the third parties you select and may not stop all data collection; you may continue to receive ads that are less relevant to you.

Disclosure of Personal Information

When the information we collect about you is aggregated, anonymized, or otherwise does not identify you, we may use that information for any purpose or share it with third parties, to the extent permitted by applicable law. We may share your personal information with the following types of entities:

  • Our affiliated businesses, to the extent they offer products or services we believe may be of interest to you.
  • Service providers we use to facilitate our business operations and administration, who have access to your personal information only to perform specific tasks on our behalf. Examples include IT and system administration providers that host our Site; customer-management software providers for scheduling, estimating, invoicing, and online payments; data storage providers; payment processors; text-messaging platform providers; and marketing, advertising, and analytics vendors.
  • Regulatory and governmental authorities, law enforcement agencies, and courts, as necessary to comply with applicable laws and regulations, respond to lawful requests and legal process, protect our rights and property or those of others, or protect the safety of the public or any person.
  • Buyers or other successors in the event of a merger, acquisition, divestiture, restructuring, reorganization, dissolution, bankruptcy, or other sale or transfer of some or all of our assets, in which case your information may be among the transferred assets.

We may also share your information for any other purpose disclosed to you at the time of collection or with your consent. As noted above, we do not share mobile opt-in or text-messaging consent information with third parties for their marketing purposes.

Your Privacy Rights and Choices

We respect your right to make choices about the ways we collect, use, and disclose your information.

  • Marketing Emails – You can opt out of receiving promotional emails by clicking the “unsubscribe” or similar link in such emails.
  • Text Messages – You can opt out of text messages by replying STOP to any message.
  • Cookies – Depending on your browser or device, you may have the option to manage cookies through your browser settings.
  • Declining to Provide Information – You can choose not to provide us with requested information, but this may limit certain Site functionalities or our ability to provide services.
  • Access, Correction, and Deletion – Subject to applicable law, you have the right to request access to the personal data we hold about you, request corrections to inaccurate data, and request deletion of your data. If you make a deletion request, we will honor it to the extent the data is no longer necessary for services you have purchased or required for our legitimate business purposes or legal or contractual recordkeeping obligations.

State Privacy Rights

Depending on where you live, you may have additional rights under applicable state privacy laws, such as the Minnesota Consumer Data Privacy Act and similar laws in other states. Where applicable, these rights may include the right to confirm whether we are processing your personal data and to access it; the right to correct inaccuracies; the right to delete personal data; the right to obtain a portable copy of your data; the right to obtain a list of the categories of third parties to whom we have disclosed personal data; and the right to opt out of the processing of your personal data for purposes of targeted advertising, the sale of personal data, or certain profiling. Minnesota residents may also have the right to question the result of profiling, to be informed of the reason for a profiling decision, and to review the personal data used in profiling.

To exercise any of these rights, please contact us using the information at the end of this Policy. We will not discriminate or retaliate against you for exercising your privacy rights. We may need to verify your identity before fulfilling your request, and you may use an authorized agent to submit a request on your behalf where permitted by law. If we decline your request, you may appeal that decision by contacting us at info@RightAwayCo.com; we will respond to your appeal within the timeframe required by applicable law.

Non-Discrimination

We will not discriminate against you for exercising any of your privacy rights. Unless permitted under applicable law, we will not deny you goods or services, charge you different prices or rates, provide you a different level or quality of goods or services, or suggest that you may receive a different price, rate, level, or quality of goods or services, because you exercised your rights.

Do Not Track

Some browsers allow you to automatically notify websites you visit not to track you using a “Do Not Track” signal. There is no consensus among industry participants as to what “Do Not Track” means in this context. Like many websites and online services, our Site does not currently alter its practices when it receives a “Do Not Track” signal from a visitor’s browser.

Children’s Privacy

Our Site is a general-audience site and is not directed at, or intended for use by, children under the age of 18. Accordingly, we do not knowingly collect personal information from children under the age of 18. If you believe that a child under the age of 18 has provided us with personal information, please contact us, and we will take steps to delete such information unless we are legally required to retain it.

Security of Personal Information

We follow generally accepted standards and use appropriate administrative, technical, and physical measures to protect your personal information from loss, theft, unauthorized use, disclosure, or modification, both during transmission and once received and stored, including the use of encryption where appropriate. While no security measures are perfect and transmission of information via the internet is not completely secure, we regularly review our practices to improve data protection and align with industry standards. Any transmission of personal information is at your own risk.

International Data Transfers

Right Away Construction is based in the United States and operates the Site from the United States. If you access the Site or provide information to us from outside the United States, your personal information may be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your jurisdiction.

Changes to This Policy

We may change this Policy from time to time. If there are changes to our Policy, we will post them here and update the “Last Updated” date at the top of this document. If we make material changes, we will provide notice as required by applicable law, which may include notifying you here, by email, or by means of a notice on our home page, and, where required, providing you a reasonable opportunity to withdraw consent to any materially different processing.
